Suppression of Evidence Due to Police Misconduct

In a significant legal victory, Attorney Joseph F. Krowski successfully defended Jimmy Roman Rosario against serious drug and weapons charges in Hampden County. Krowski filed a motion to suppress evidence obtained through a search warrant, arguing that the warrant affidavit contained false statements due to police misconduct.

The court granted the motion to suppress, acknowledging that the search warrant was based on a false affidavit. This suppression of evidence led the Commonwealth to seek an interlocutory appeal under Mass. R. Crim. P. 15(a)(2). However, the appeal was not pursued, and the state charges were eventually dropped.

Subsequently, Rosario was indicted on federal charges related to the same evidence. Despite the federal indictment, the state court’s decision to suppress the evidence remained a testament to Attorney Krowski’s dedication to upholding his client’s constitutional rights.

This case underscores Attorney Krowski’s commitment to challenging unlawful police practices and ensuring that justice prevails, even in complex and high-stakes situations.
